Terms of Sale

This English version is a translation provided for convenience. The French version is the only binding one and prevails in the event of any discrepancy.

These Terms of Sale (Conditions Générales de Vente, CGV) govern the sales made by CorshCrafts, a craft workshop run by Alexandre Bourdin (hereinafter “the Seller”), to any natural or legal person making a purchase (hereinafter “the Customer”).

Placing an order implies the Customer’s full acceptance of these Terms of Sale.

1. Seller’s identity

Trade name: CorshCrafts

Sole trader: Alexandre Bourdin

Email: alex@corshcrafts.art

SIRET: 78860961800020

Registered office: Monthieux, 01390, France

2. Products and services

CorshCrafts offers handcrafted pieces, including tabletop role-playing accessories and decorative objects.

Products may be:

  • Items in stock offered for sale in the shop
  • Custom pieces made at the Customer’s request, once a quote has been approved

Each handcrafted piece may show slight variations (shade, grain, finish) that are inherent to handwork and natural materials.

3. Prices

Prices are shown in euros (€). VAT not applicable, article 293 B of the French General Tax Code (VAT franchise for small businesses).

Shipping costs are stated before the order is finally confirmed and are shown separately where applicable.

4. Orders

4.1 Products in stock

The order is deemed final once payment has been validated and the Seller has confirmed it.

4.2 Custom orders

Every custom order is the subject of a detailed quote. Accepting the quote, together with paying any deposit, constitutes a firm commitment by both parties.

Any change requested after the quote has been approved may lead to an adjustment of the price and lead times.

5. Payment

Payment may be made using the methods offered when ordering (secure online payment, bank transfer, other methods stated on the quote or invoice).

For custom pieces, a deposit may be required before production starts.

Unless otherwise agreed in writing, the balance must be paid before the product is shipped or handed over.

In accordance with the rules applicable to distance selling, an invoice is issued for every order placed on the website or concluded at a distance, and is sent to the Customer electronically or included with the parcel. For sales concluded with both parties present, an invoice is issued on the Customer’s request.

Once issued, an invoice can no longer be changed; any correction (error, partial or full refund) takes the form of a credit note attached to the original invoice.

6. Production and delivery times

The Seller delivers the goods on the date or within the time stated to the Customer when ordering or on the quote. Failing any indication, delivery takes place no later than thirty (30) days after the contract is concluded, in accordance with article L216-1 of the French Consumer Code. Estimated lead times may vary because production is handcrafted; CorshCrafts undertakes to inform the Customer of any significant delay.

If the Seller fails to meet its delivery obligation under the conditions above, the Customer may terminate the contract under the conditions of articles L216-6 et seq. of the French Consumer Code, after having unsuccessfully required the Seller to deliver within a reasonable additional period.

In accordance with article L216-4 of the French Consumer Code, the risk of loss of or damage to the goods passes to the Customer when the Customer (or a third party designated by the Customer, other than the carrier offered by the Seller) takes physical possession of them. When the Customer entrusts delivery to a carrier of their own choosing, other than those offered by the Seller, the risk passes when the goods are handed over to that carrier. On receipt, the Customer is advised to check the condition of the parcel, to note any reservations with the carrier if necessary, and to report any problem to the Seller as soon as possible; making no reservations does not deprive the Customer of any of their legal rights.

7. Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, a Customer who is a consumer has fourteen (14) days from receipt of the goods to exercise their right of withdrawal, without having to give a reason.

This right does not apply to goods made to the Customer’s specifications or clearly personalized (custom pieces), in accordance with article L221-28 of the French Consumer Code.

To exercise this right, the Customer notifies their decision to withdraw before the period expires, by an unequivocal statement sent by email to alex@corshcrafts.art, for example using the model form below.

The Customer sends the goods back to the Seller without undue delay and no later than fourteen (14) days after communicating their decision to withdraw. The cost of returning the goods is borne by the Customer. The goods must be returned complete, in their original packaging or in packaging offering equivalent protection; the Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

The Seller refunds the Customer all sums paid, including standard delivery costs, without undue delay and no later than fourteen (14) days from the date on which the Seller is informed of the decision to withdraw. The refund may be withheld until the goods have been received back, or until the Customer has supplied evidence of having sent them back, whichever is earlier.

8. Returns, complaints and warranties

Any complaint must be made by email within a reasonable time after receiving the product, with supporting photos if necessary.

The Customer benefits from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). In accordance with article D211-2 of the French Consumer Code, the consumer is informed as follows:

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer need only establish the existence of the lack of conformity, not the date on which it appeared.

Where the contract of sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer need only establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.

The legal guarantee of conformity obliges the professional, where applicable, to supply all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and obtain a full refund in exchange for returning the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;

4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to ask for the goods to be repaired or replaced first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.

The rights mentioned above result from the application of articles L217-1 to L217-32 of the French Consumer Code.

A seller who obstructs in bad faith the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.

Defects resulting from misuse, lack of maintenance, normal wear and tear or damage caused after delivery are excluded from the warranties.

9. Liability

CorshCrafts cannot be held liable for indirect, intangible or unforeseeable damage related to the use of the products sold.

In any event, the liability of CorshCrafts is limited to the amount of the order concerned, unless a mandatory legal provision states otherwise.

10. Personal data

The processing of personal data is described on the “Privacy Policy” page, available from anywhere on the website.

11. Governing law and disputes

These Terms of Sale are governed by French law.

In the event of a dispute, an amicable solution will be sought first.

Failing an amicable agreement, the dispute will be brought before the competent French courts.
